Starting a business focused on selling food items like empanadas and pompanadas requires various licenses and permits to ensure compliance with local, state, and federal regulations.

While the specifics can vary by location, here's a general overview of the types of licenses and permits you might need:

Business License

  • A general business license is required to legally operate your business in your city or county. This license is the fundamental authorization to do business in your local area.
  • Food Service License

  • This license is required for any establishment that prepares and sells food to the public. It's issued by the local health department and requires an inspection of your facility to ensure it meets health and safety standards.
  • Sales Tax Permit

  • If you're selling goods, like empanadas and pompanadas, you'll need to collect sales tax. A sales tax permit is required for this purpose.
  • Food Handler's Permit

  • Most local health departments require that any employee who will be handling food obtain a food handler's permit, sometimes referred to as a food worker's card. This ensures that all employees understand basic food safety practices.
  • Catering License

  • If you plan on offering catering services as part of your business, a catering license may be required. This often involves additional health department inspections to ensure your catering operations meet health and safety guidelines.
  • Health Department Permit

  • This permit is crucial for any food service establishment. Obtaining it typically involves an inspection from the health department to ensure your business complies with local health codes and regulations.
  • Zoning and Land Use Permits

  • Before opening your business, you'll need to ensure that your chosen location is zoned for commercial use and that food service is an allowed activity within that zoning category.
  • Sign Permit

  • If you plan to display signage for your business, you may need a sign permit from your local government. Regulations regarding the size, location, and lighting of signs can vary greatly.
  • Fire Department Permit

  • If your business requires a significant amount of cooking, you might need a permit from the fire department, especially if you're using open flames or have an extensive exhaust system.
  • Alcohol License

  • If you plan to sell alcoholic beverages alongside your food items, you will need an alcohol license, which can vary significantly in terms of requirements and difficulty to obtain depending on your location.

You can choose to be a(n) Food :

    • Sole Proprietor,
    • LLC,
    • Corporation or
    • Partnership.
After you decide and select your business entity, you need licensing.

Bayonne Business Tax Registration ( Business License)
All businesses including home, online or mobile BUSINESS need a BUSINESS license because they are BUSINESSES.

A(n) Food business using a DBA Doing Business As Trade Name in Hudson County , i.e., starting businesses using a company name other than the legal (given name) owner's name, need a(n) DBA Doing Business As Trade Name Registration.   For example, you start a(n) Food business and you call it "Ultra Food Co". You will need to file a trade firm name for it.

Also, keep in mind that in New Jersey though, a business license and a DBA is necessary for most businesses but if your business sells any taxable items, you will need a sales tax ID number.  (A.K.A state id, wholesale, resale, reseller certificate, about $39 for most states).
    Seller's Permit

Note: All businesses need a federal tax ID number except sole proprietors that are not employers and are not independent contractors.
An independent contractor is a self employed business person that receives more than $600 per year from anyone of his or her clients.
IRS rule: The client must issue a 1099 form to the independent contractor and the independent contractor must have a federal tax ID. However, even sole owners may obtain a federal ID and use it as a business tax ID instead of using their own social security number as a business tax ID number.
However, all other licenses that apply to sole proprietors as discussed here are requited regardless of getting a federal tax ID number.

If you are thinking of hiring help, you will need a state employer ID and an IRS number employer ID. I.e., a NJ Federal Tax Id Number ($29)  and a(n) NJ  State Employer Tax Number

Instead of filing a fictitious business name DBA Filing (about $49 plus state and legal newspaper publication fees) in Bayonne, Incorporate in NJ  or form a(n) NJ LLC

If you will set up a corporation or form an LLC, you will not have to file a DBA (Doing Business As) unless your corproration or LLC name will be different that the busienss name you will trade under. Businesses that use the full legal name of the owner as a business name do not need to register an assumed business name. So, for example, your name is "John X Doe" and you use that as a business name.

If you do form an Food And Dining llc or incorporate (about $49 plus state fees for most states) your Food business instead of just filing a fictitious business name (dba), it will help you avoid legal and financial personal liability arising out of business transactions and you will not have to register the Bayonne business name. Instead of filing a Hudson County fictitious business name (our service fee includes dba business name filing and legal paper publication) you can elect to incorporate in New Jersey or form an NJ LLC (starts @ $49 plus state fee for most states & includes bylaws and LLC operating agreement)..

    About Your Business Type

    Food

“Life is uncertain. Eat dessert first.” – Ernestine Ulmer

Food businesses include: Restaurants, Fast Food, Homemade Food, Catering, Food Trucks, Mobile Food Vendor, Food Carts, Coffee Shops, Catering, Food Stands, Bars that Serve Food, Carry-out restaurants, Pizza Restaurants, Pizza Taco Stands, Grocery Stores.

Q:Selling food from home. Meals include cooked meat, pasta, and veggies. Food prepared in a home kitchen

ANSWER: Hi Alisa, yes, you can open a Deep Fried Turkey Catering and the good news is that catering from home is ok. Namely, Homemade Food (HMF) sales are allowed, but you can only make food that is not potentially hazardous.

Operators can use their home kitchen to produce products to sell directly to consumers.

However, keep in mind that homemade food sales by internet, mail order, consignment or at wholesale are not allowed.

Regardless, homemade food is subject to sales tax, so you will need to register a seller's permit.

That being said, you still need to register your business name "Uncle O"S Deep Fried Turkey," with a DBA, LLC or a corporation, get an EIN, a business license and if hiring a state EIN as well.

That said, everything else is like any other business.

For example, you need to select a legal structure such as LLC or partnership, and obtain a certificate for that structure.

Selling food to the public in a food cart. Self-employed, at a location not at home. I am working on a location. Do I need licensing for mobile food?

ANSWER: Hi Brian, food businesses need all licensing like any other business as described below.

However, food businesses also need another type of permit or license, and that is a health permit.

That means that after you apply for all licensing here, then they will ask you to get a health permit as well.

That means that the city inspector has to come and take a look at whether the food and food service preparation and serving areas comply with current hygiene regulations.

For example, your food premises or mobile truck, trailer or cart, must comply with the FDA Food Code, which is a “model” code (guideline) that provides over 3000 local, state, tribal and federal food control agencies scientifically sound food safety information that follows national food regulatory policies such as following four simple steps—clean, separate, cook, and chill, which can help protect from food poisoning.

Here is a quote about food: "People who love to eat are always the best people." "Eating is a necessity, but eating intelligently is an art." "We all eat, and it would be a sad waste of opportunity to eat badly." "If you really want to make a friend, go to someone's house and eat with him...the people who give you their food give you their heart."

That said, yes, you do need licensing.

First, "Bite Me Main Mobile Food, LLC," requires the creation of 2 legal documents:

One is the LLC certificate that has to be registered with an official article of organization, and the other, is the preparation and execution(singed and notarized but notarization not absolutely necessary) of an LLC operating agreement.

You need to set up an LLC because the suffix LLC denotes that you are an LLC.

If you don't want the "LLC" suffix, you have 3 more options for selecting your legal structure.

So, other than the LLC, you can select to be:

    1. Sole proprietor,
    2. Partnership,
    3. Corporation.

So, you may want to be a corporation with an "Inc" suffix or a sole proprietor or partnership without any suffixes.

That said, regardless of which structure you select, you still need at least a business license and an EIN.

That is not all, however. Because food when sold is subject to sales tax, you need to obtain a seller's permit that you can use to collect the sales tax for each sale and then remit the tax to the State quarterly or however the State decides that you have to remit it, which it could also be semi-annually or annually.

The seller's permit can also be used to buy any prepared food, such as chips bags, or jars of food, wholesale. In most states, raw food is not subject to sales tax.

Finally, hiring food workers to prepare and or to sell the food, requires a federal EIN and a State EIN as well because you need to remit and report employment taxes to both the federal and state government.

Employees pay half of their Social Security and Medicare taxes. The employer must pay the other half.

This means they pay 5.65 percent of employee wages for these taxes and withhold the employee’s tax and pay that as well to the government(s).

      STARTING A FOOD BUSINESS
Question:Hi am Frank. I am a mobile food vendor. I.e., I am selling food/ice cream/snow cones etc., from a food trailer/ food truck/ food cart/ food catering truck? Hello, I want to start a business, okay. I have an LLC that is reg. However, I am wanting to be a vendor at events to sell food such as fried fish shrimp chicken and fries what is all needed where I sell Mobile Food that I grow. I would like to be able to sell as a vendor on the street and at farmers markets. What permits will I?
    .

    Here is What You Need...

Licenses and Permits for a Mobile Food Vendor Business

    • Mobile Food Vendor License - You will need a license or permit to operate a food truck or cart.
    • Business License - A general business license is required to legally operate in your state.
    • Food Service Permit - Obtain a food service permit that covers serving food from a mobile facility.
    • Sales Tax Permit - Apply for a sales tax permit to collect and remit any sales tax on your food sales.
    • Proof of Insurance - You must have commercial auto insurance for a food truck and liability insurance.
    • Fire Inspection - Your mobile food unit will need to pass a fire safety inspection by the fire marshal.
    • Commissary Agreement - A licensed commercial kitchen must be available for storing/prepping food.
    • Food Manager Certification - In most cases, at least one staff member must have a food safety manager certificate.
Check with your local health department about permits and operation regulations for mobile food businesses.

    ANSWER:

Hey Frank, looks like you want to join the foodie wagon as a mobile food vendor. Did you know that the restaurant industry is worth a whopping $799 billion dollars? That's a lot of cheddar! And with 1 million+ restaurant locations in the United States, you're sure to find your slice of the pie.

But before you start slinging those burgers and fries, you'll need a general business license, a DBA registration, and a seller's permit. And if you plan on hiring some help, you'll need both a federal and state EIN employer tax ID number.

Don't forget about passing that health inspection! You'll need to enroll in a Mobile Vending Compliance Program, which might require you to take a food handler certification class and quiz. We don't want any unsanitary food being sold on your truck or cart, right?

But once you've jumped through all the hoops and hurdles, you'll be ready to serve up some delicious eats to hungry customers on the street. So, get ready to rock and roll with your Mobile Food is Good Food business!

(Food Cart, Food Truck, Catering Truck, Ice Cream Truck, Concession Food Trailer etc.)

Whether selling on the Mobile or from a fixed outdoor location such as a sidewalk, the following applies to you.

I will sell prepared food/ice cream/snow cones etc. to people on the street.

    Answer:

    Step 1

To sell food on the Mobile, you will need a general Business License, a DBA and a seller's permit.

    Step 2

First, prepare your truck or food cart, and obtain a general Business License, a DBA registration if you use a trade name such as "Mobile Food is Good Food," and also obtain a seller's permit.

    Step 4

Most Mobile vendors do not have employees, but if you do, you will need both a federal EIN and a state EIN employer tax ID number.

    Step 5

After you apply here online for a general Business License, we will give you all the information and the government may also call you and set up an appointment that you will have to meet to pass the health inspection.

You will have to go through a program that most governments have implemented called a Mobile Vending Compliance Program due to many complaints received about unsanitary food.

The program may include a food handler certification program that you get after taking a short class and a quiz. Note that your cart or truck will also have to go through and pass a health inspection.

    LLC (Limited Liability Company) FAQs:

Q: Should I consider forming an LLC?

A: If you want more business credibility in the business market, you may want to form an LLC instead of a DBA. For example, if your trade name is. deas XYZtch , Inc.Co. requires a fictitious business name registration, which also requires a fee to be registered.

Registering a fictitious business name does not protect that name nor does it protect the business owner from personal liability related to business actions as setting up a limited liability company (LLC) does. Our recommendation that since you need to pay a fee to register the business name, simply form a limited liability company (LLC) for a similar fee and get both corporate status and protection for the name as well as personal liabilities.

So, for instance, if someone slips and falls in your business premises, they can sue you personally if you are not a limited liability company (LLC).

Also, consider the prestige that a limited liability company (LLC) affords. Is a name like John's Transmissiona shop better than AEMCOO TRANS, LLC?

Q: I am just one person. Do I Need an LLC?
A: Even if you are just one person owner, you can form an LLC (Limited Liabiliity Company).

Q: Do I need an EIN for my LLC?
A: Yes, you will need an EIN for your LLC to do your LLC taxes and open an LLC bank account.

Q: Do I need to file a DBA if I form an LLC?
A: If you form an LLC and you do business as the LLC name, you don't need a DBA. For example, your LLC name is "Ultra Super LLC," and your business name is "Ultra Super LLC," you don't need to file a DBA.

Q: If I set up an LLC, will the LLC help me protect my business LLC from creditors?
A: Yes, actually, only an LLC can help you protect the LLC from its creditors especially if you have another partner member owner in that LLC.

Q: Do I need to obtain a federal or state tax ID number before forming a limited liability company (LLC) or getting other licenses?
    A:

Q: How do I build credit under my LLC business?
A: Start by applying for a line of credit for your LLC from your bank if you already have some personal credit.
