What are the requirements for bakery Retail Trade legal registration? I'm wondering what licensing do I need for bakery. i e what is the first step because I am planning to open my own business bakery thus I was wondering Dba Baker Ywoodland Park Co? Should a Retail Trade bakery in Woodland Park, Colorado need to reflect on perhaps an LLC Formation Permits and Tax IDs Required To Start my Own New Business 80863, :

All Retail Trade bakery business (including home mobile and online -- regardles of the type) are required to get a(n) in Woodland Park businesses, MUST Obtain a(n) Business License business license.

Starting Your Own Homemade or other Baked Goods Business
Before starting a Homemade or other Baked Goods Business, let us see what it is: A homemade baked good could be a cupcake, in England, fairy cake, and Australia, patty cake or cup cake, is a small cake designed to serve one person, frequently baked in a small, thin paper or aluminum cup. Other baked goods include biscuits, large cakes, cookies and other pastries. As with larger cakes, frosting and other cake decorations, such as sprinkles, are common on cupcakes and baked goods.
Is a Baked Goods Business Subject to Sales Tax?
Since a cake, biscuit, or cupcake or pastry is prepared food, then you must charge taxes before selling it – unless you sell it wholesale. In either case, you will need a wholesale ID also called a resale license to either sell the baked goods wholesale, buy the wholesale or sell them retail in small amounts. This is because any type of prepared food, even cupcakes, is a taxable sales event when it takes place.
What Other Baked Goods Licensing Do I Need?
Other than the baked goods seller permit, you will need an general occupational business license and a filing of a fictitious assumed name also called a DBA standing for Doing Business As. See example below.
What if You Name You Cupcake Business "Super Delicious Baked Goods," or something like that?
So, if you name your homemade baked goods business “Cakes and Other Baked Goods That Make You Lose Fat,” you will need to register the name with an assumed fictitious business name DBA filing.
What If I Hire Employees to Help Me Make Homemade Baked Goods?
You will then be a baker or baked goods employer business and you will need a federal and a state ein also called employer withholding tax id numbers.

Starting a bakery in Herrin, IL: which licenses and registrations do I need?

Katrina wrote: “I make homemade cakes, cookies, and pastries from my home bakery and also offer full all-inclusive party planning.”

Hi Katrina, 2 Peas N A Pod sounds like a promising venture. Pairing custom cakes with party planning lets one celebration bring in several sales and plenty of future referrals. Below we walk through the three things every new business in Illinois sorts out (structure, tax IDs, and licenses) and then sum it all up.

Selling home-baked cakes and cookies in Illinois falls under the cottage food rules, which require registering as a cottage food operation and labeling each item; frosting with cream cheese or anything needing refrigeration usually isn't allowed under those rules. Party planning is a service, so it adds little paperwork of its own, but if you bundle your desserts into party packages, keep the food portion clearly priced so sales tax is handled correctly.

What 2 Peas N A Pod needs

  1. LLC (business structure) – An LLC keeps business debts and lawsuits separate from your personal home and savings. If a guest at a party you catered has a severe nut reaction, an LLC keeps the lawsuit pointed at the bakery instead of your house.
  2. DBA (doing business as) registration – If you operate as a sole proprietor, or under a name different from your LLC's exact legal name, registering "2 Peas N A Pod" lets you use it on signs, invoices, and your business bank account.
  3. EIN (federal tax ID number) – Think of the EIN as a Social Security number for the business: banks, suppliers, and clients who send you tax forms will all ask for it.
  4. Illinois sales tax registration – You will be selling taxable goods, so register to collect sales tax before your first sale. It also lets you buy inventory for resale without paying tax on it.
  5. Business license – Most places require a local business license to operate, including home-based businesses. Check the rules where 2 Peas N A Pod will operate in Herrin, and ask about home occupation and zoning rules if you work from home.
  6. Cottage food or food establishment permit – Home bakers often qualify under cottage food rules, while a storefront or commercial kitchen needs a full food permit.
  7. Food handler card – Many states require a short food safety course for anyone baking or selling food.

By the numbers: Banks, insurers, and tax forms will ask for your industry code. For a bakery it is NAICS 311811 (Retail Bakeries). That makes 7 items on your list.

Tip: Check whether your cottage food rules allow sales at events or online before you book fairs or ship treats.

To recap: 2 Peas N A Pod in Herrin, IL needs an LLC, a DBA, an EIN, a sales tax permit, a business license, cottage food or food establishment permit, and food handler card. Handle these early and the business starts on solid ground.

Retail Trade bakery
If you are a partnership means you are a business entity with multiple owners and thus you will need a dba and a federal ID.
If you are a service but you also use parts you will need a sellers permit also called a resale license or resale certificate to collect taxes and or buy wholesale.
Though raw food is not taxable prepared food is taxable .
so you need a resale license.

If you are a professional such as an architect or doctor you also need a professional license from the state.

You can choose to be a(n) bakery :

  • Sole Proprietor,
  • LLC,
  • Corporation or
  • Partnership.
After you decide and select your business entity, you need licensing.

Woodland Park Business Tax Registration ( Business License)
All businesses including home, online or mobile BUSINESS need a BUSINESS license because they are BUSINESSES.

A(n) bakery business using a fictitious business name in Teller County i.e. you are a business with a trade name other than the owner's legal (full name) name are required to get a(n) fictitious business name.   For instance you open a(n) bakery business and you name it "Superior bakery Group". You will need to file a fictitious business name for that name.

In addition note that in Colorado you may also need a seller's permit if you sell merchandise that is taxable.  (A.K.A state id, wholesale, resale, reseller certificate, about $39 for most states).
Seller's Permit

Note: All businesses need a federal tax ID number except sole proprietors that are not employers and are not independent contractors.
An independent contractor is a self employed business person that receives more than $600 per year from anyone of his or her clients.
IRS rule: The client must issue a 1099 form to the independent contractor and the independent contractor must have a federal tax ID. However, even sole owners may obtain a federal ID and use it as a business tax ID instead of using their own social security number as a business tax ID number.
However, all other licenses that apply to sole proprietors as discussed here are requited regardless of getting a federal tax ID number.

In addition you will need a federal and a state EIN if you will hire employees. I.e., a CO Federal Tax Id Number ($29)  and a(n) CO  State Employer Tax Number

Instead of filing a fictitious business name DBA Filing (about $49 plus state and legal newspaper publication fees) in Woodland Park, Incorporate in CO  or form a(n) CO LLC
.

You have a choice to file a DBA or form an LLC or incorporate. There is a cicrcumstance that you may not need to register a trade name and that is when you use your full name as a business name if you use your full legal name as a trade name.
Also note that even using your first and last name may not help you avoid filing a DBA if the name has a suffix such as "& sons" etc.

If you do form an Retail Trade llc or incorporate (about $49 plus state fees for most states) your bakery business instead of just filing a fictitious business name (dba), that insurs that you don't have personal liability for debts and civile liabililty arising from your business dealings and you will not have to record the Woodland Park business name. Instead of just registering your Teller County assumed business name (our fee includes assumed business name registration and legal newspaper publication) you can choose to setup a corporation in Colorado or form an CO LLC (starts @ $49 plus state fee for most states & includes required documents such as bylaws for the corporation and Limited Liability operating agreement for the LLC). .

About Your Business Type

Bakery

Question: I will be baking goods such as cupcakes in my kitchen from products that I will buy in bulk and sell to people I know and others who hear about me. I will deliver the products or customers will pick them up.
I AM SELLING CUSTOM MADE CAKES AND CUPCAKES.

DO I NEED A HOME BAKERY LICENSE?

I have a question regarding having a bakery. What kind of licenses do I need?

I intend and would like to sell baked goods like custom cakes, cookies, cupcakes etc. out of my home business and I want to know if I need a state resell license.

Does my state allow the sale of home baked goods? I am to know more about LLC, S-Corps, etc. as well. But, mainly, I want to know if I can get LEGAL permission to sell baked goods that I make in my kitchen in my state.

What are the licenses that I will need to obtain a baking business to sell custom cakes and cupcakes?

Answer:
Hi Daniela, yes, you need special health permission to bake out of your home kitchen. The permit is issued after inspection to make sure that you don't have domesticated animals, such as pets, and in general, the environment is sanitary to bake and sell cupcakes. In addition, yes, you need a home bakery license to sell your custom cakes. In addition, you do need a reseller license (it is called a seller's permit).

An LLC or an S-corporation is the best bet for your business because baking cakes involves accidental poisoning to your clients, and you want to protect your personal assets such as your home and other luxury items you possess.

That said, cakes are "So Sweet. So Good. Sure to bring smiles." but also the Sweet Taste of Success: you will be happy all the way to the bank.

So keep in mind that the secret ingredient in baking is always love.

For me, baking is my therapy, because baking is cheaper than professional therapy. I am actually eating a vanilla keto cookie right now, with just 11 grams off for two cookies.

Super delicious, made with allulose sugar substitute as well as a small amount of cane sugar (2grams for 2 cookies). Anyway, sometimes you just need to bake: especially if you have O.B.D (Obsessive Baking Disorder).

Licensing

Like any business, you will need a general Business License for your baking cakes business that you can order here online. The license includes several steps, such as a health clearance for the kitchen where you bake your cakes.

Naming Your Cake Business

Using a fictitious business name, such as "Cakes and Bakes," will require a DBA biz name filing as well. Thus, your business name "Mom's Dangerously Delicious Cakes Cupcakes Cake-Up!," or the other one, " is a trade name and is required to be registered.

Why? Because it is not your legal name, but just a name you imagined and wrote down: namely, a fictitious business name. I.e., it is not your legal name, "Daniela La Bella Daniels".

Tax IDs Required For Baking Cakes Business

Bless Your Heart Bakery LLC"
Also, note, since cakes are prepared food, you will also need a Seller's Permit license, so you can buy your baking cakes materials wholesale and sell them retail. You also need a federal and state EIN if you will hire employees to help you with baking cakes.

Quote: "This was why she enjoyed baking. A good dessert could make her feel like she'd created joy at the tips of her fingers. Suddenly, the people around the table were no longer strangers. They were friends and confidantes, and she was sharing with them her magic." — Marissa Meyer
Let’s roll out the dough and break this down into tasty business bites. You're entering the baked goods biz—*yum*—and guess what? The U.S. baking industry kneads no introduction (yes, pun intended). With annual revenues cooking past **\$40 billion**, you're stepping into a market that smells like opportunity—and frosting. Now, whether you're whipping up cupcakes from your kitchen or opening a full-blown storefront with espresso on tap, here's what you knead… I mean, need. ---

Capital & Equipment to Get Rolling

Before we get all legal-flavored, let’s whisk through some basics:
  • Startup Capital: Around $2,000–$50,000 depending on size. Cottage-style? Small bill. Bakery café? Bigger budget.
  • Equipment: Ovens (duh), mixers, refrigerators, display cases, baking trays, and the all-important frosting spatulas.
  • Ingredients: Flour, sugar, love, and a sprinkle of originality.
  • ✅ A food processor is great. But *you* are the real processor here. ---

Do I Need an LLC or S Corp?

✅ **Yes** – especially if you’re looking for legal protection and tax perks. Here's why:
  • **LLC** (Limited Liability Company): Shields your personal assets if someone sues over a rogue brownie. Simple setup and flexible taxes.
  • **S Corporation**: Fancy option if you plan to scale big. Helps avoid double taxation and lets you pay yourself a salary + distributions.
  • Example: "Sweet Tooth Treats, LLC" just sounds better on a cookie box than “Jane’s Side Hustle.”
  • ---

Should I Register My Business Name?

✅ **Yes** – If you’re using a business name other than your own legal name.
  • Example: If your name is Sara Smith and your bakery is “Crumble & Whisk,” you’ll need to register that name.
  • Why? So no one else can legally snatch your name and start selling dry muffins under it.
  • ---

What’s an EIN and What’s It For?

✅ **EIN** = Employer Identification Number. Think of it as your business’s Social Security number.
  • Used to open a business bank account, file business taxes, and hire employees.
  • Even if you’re a one-person baking band, having an EIN makes you look pro—and may be required when dealing with suppliers or wholesalers.
  • Bonus: It keeps your personal SSN out of business paperwork.
  • ---

    Licenses & Permits You’ll Need

Here’s the sweet checklist you’re really here for. Get ready to sprinkle these over your setup:
  • ✅ **LLC or Corporation Registration**
  • ✅ **Business Name Registration** (if doing business under a name that’s not your own)
  • ✅ **Seller’s Permit** (needed if you sell tangible goods like cookies, bread, pies)
  • ✅ **Business License** (legally allows you to operate your biz)
  • ✅ **Home Occupation Permit** (if you’re baking from home)
  • ✅ **Health Department Permit** (food safety is a thing… and so are inspections)
  • ✅ **Food Handler's Certification** (so you know where gloves end and dough begins)
  • ✅ **Zoning Permit** (especially if you’ve got a storefront)
  • ✅ **Fire Department Clearance** (because ovens + wiring = better safe than scorched)
  • ✅ **Resale Certificate** (to buy ingredients wholesale without paying sales tax)
  • ✅ **EIN** (especially if hiring employees or forming an LLC)

    LLC (Limited Liability Company) FAQs:

Q: Would an LLC be better than filing a fictitious business name?

A: If you desire more business prestige for market presence you may want to set up an LLC. E.g. the fictitious business name (DBA) is . deas XYZtch Above the Clouds BakeryCo. this name as well as any other name is an assumed business name and it must be recorded as a DBA Doing Business As name which also requires a fee to be recorded.

Just recording an assumed business name does nothing to keep the name exclusive nor does it avoid personal liability for the business owners. Only setting up a limited liability company (LLC) will protect the name at the state level and also protect the owners of personal liability. It is perhaps a better choice to just incorporate for the same or a little higher fee because you will also have corporate protection for the business name and personal vs business liabilities.

E.g. if your business has debts the lender can sue you personally to obtain a judgment vs your personal assets as opposed in the case you were a corporation where the lender could only sue the corporation directly and if the limited liability company (LLC) had no assets the lender could get nothing.

A limited liability company (LLC) affords more prestige and it helps you obtain business loans.

Q: Can I apply by phone and set up a limited liability company (LLC)?.
A: You can apply by phone but the best way is to just fill out our online limited liability company (LLC) form.

Q: I already have a tax ID as a sole proprietor can I use it for the LLC I am forming now?
A: Forming a new type of entity of a business constitutes change of status for that business and that requires you to get new licenses and tax IDs under your name.

Q: What if I an an out of state business? Do I still need to register and obtain a limited liability company (LLC)?
A: Unless you have a location in the state you sell it is not required to form an LLC there.

Q: If I order a limited liability company (LLC) online how long will it take before I receive it?
A: Normally we will have to wait for a corporate certificate if you are a corporation othewise we normally obtain it on the same day you order it.

Q: Do I need to obtain a federal or state tax ID number before forming a limited liability company (LLC) or getting other licenses?
    A:

Q: What is a DUNS Number?
A: Dun & Bradstreet is a business credit rating company and they use your info to inform lenders about how credit worthy you are.

Q: Do I need to pay sales tax to the state as an LLC?
A: Paying sales tax depends on your state. For example in Oregon you dont need to pay sales tax but you still need a resale certificate to buy from other states wholesale products.
