I am starting a food service business with my husband. We are looking to buy a food truck here soon. Right now, we sell plates directly to the public out of the house. I do not have any employees and I don't plan on hiring any anytime soon, does that make a difference?

Starting Your Own Food Service Business
Before starting a food business, let us see what it is:
The food business has a long range of types of food operations. For example, it can be a business at home bakery or a large restaurant.
There is catering, bars, food trucks, hot dog stands etc.
All food businesses need a re-seller permit because prepared food is taxable.
Since a food business is prepared food, then you must charge taxes before selling it – unless you sell it wholesale.
In either case, you will need a wholesale ID also called a resale license to sell the cupcakes wholesale, buy they wholesale or sell them retail in small amounts.
This is because any type of prepared food, is a taxable sales event when it takes place. Other than the food seller permit, you will need an occupational Business License and a filing of a fictitious firm name also called a DBA.
So, if you name your food business “Whole Food That Will Make You Skinny,” you will need to register the name with an assumed fictitious business name DBA filing. Here is how to get your Business License for your food business.
First, you will need to food certified.
• Note: In some cases, you will not be able to cook from your house. If they does not let you cook from home, your best bet (only other option in fact) is to find a commercial kitchen restaurant that is health inspected and use it to cook, or at least get a paper from them saying that you will be using their kitchen to cook.
• Prepare your restaurant, food cart, street food vendor, or food truck for health inspection and go with the completed Business License application to the county planning dept including fire and sheriff in some cases. These departments will look at the application and most likely sign it as ok.

ANSWER: Hi Brian, food businesses need all licensing like any other business as described below.

However, food businesses also need another type of permit or license, and that is a health permit.

That means that after you apply for all licensing here, then they will ask you to get a health permit as well.

That means that the city inspector has to come and take a look at whether the food and food service preparation and serving areas comply with current hygiene regulations.

For example, your food premises or mobile truck, trailer or cart, must comply with the FDA Food Code, which is a “model” code (guideline) that provides over 3000 local, state, tribal and federal food control agencies scientifically sound food safety information that follows national food regulatory policies such as following four simple steps—clean, separate, cook, and chill, which can help protect from food poisoning.

The seller's permit can also be used to buy any prepared food, such as chips bags, or jars of food, wholesale. In most states, raw food is not subject to sales tax.

Finally, hiring food workers to prepare and or to sell the food, requires a federal EIN and a State EIN as well because you need to remit and report employment taxes to both the federal and state government.

Employees pay half of their Social Security and Medicare taxes. The employer must pay the other half.

This means they pay 5.65 percent of employee wages for these taxes and withhold the employee’s tax and pay that as well to the government(s).
