 Legal Business Licensing Requirements Applying To Any State Any Business

 All Businesses, Regardless of Type, Need to select a legal business entity structure such as sole proprietor, partnership, LLC or corporation. - This is important because any license, permit or tax registration will be filed under the entity you select. Selecting an entity required a document filing.
- E.g., if you select an LLC, you will need to file an LLC certificate.
- The only situation you do not need to file for a sole proprietorship is if you are a sole owner doing business as your own full legal name. E.g., if your name is John Doe and you do business as (DBA) "John Doe," you will not need to file a DBA business name registration.
- However, you still need to file all of the following that apply to your business.
- All Businesses, Regardless of Type, Need a General Business License DBA Business Name Registration. E.g., You are consultant John Smith doing business as (DBA) "Rob 'em & Cheat 'em Consulting". You will Need to Register DBA Business name.
- Retailers / Wholesalers, Need a Seller's Permit, General Business License. E.g. if you selling or leasing any toys, clothing or any merchandise or equipment, or selling prepared food including drinks, you will need a Seller's Permit to buy or sell wholesale in large amounts or retail in small amounts.
- Employers Need a Federal Tax Id Number State Tax Number, General Business License. This numbers are required to report and pay employment tax.
- Corporations, & LLC Need a Federal Tax Id Number General Business License.
- Partnerships Need a Federal Tax Id Number General Business License.
- Sole Proprietors Can Use a Federal Tax Id Number as a General Business License DBA.
- Instead of filing a DBA, You Can Incorporate form an LLC You Will Not Need To Register a DBA Trade Name Unless It Is Different From The Corporation or LLC Name. E.g., Corporation name is "Costco," doing business as (DBA) "Kirkland," "Kirkland," needs to be filed as a DBA under the Costco corporation.
